("ENERGENIC GL / US / OUR / WE")
IN TERMS OF THE PROTECTION OF PERSONAL INFORMATION ACT NO. 4 OF 2013 AND REGULATIONS (AS AMENDED) ("POPIA")
1. INTRODUCTION
1.1 Energenic GL, in our capacity as a Responsible Party, recognizes the constitutional rights of a person to privacy and acknowledges that it is of the utmost importance, as required by law, to protect the Personal Information pertaining to the relevant parties concerned.
1.2 Energenic GL is committed to the safeguarding of such information as well as ensuring that Personal Information is processed appropriately, transparently, securely and in accordance with POPIA and other applicable laws.
1.3 This Policy explains how Energenic GL collects, uses and protects Personal Information and by a data subject providing Energenic GL with his/her/its Personal Information, the data subject agrees to this Policy and authorizes Energenic GL, its service providers and other third parties to process his/her/its Personal Information for the purposes as set out herein.
1.4 For purposes of this Policy:
"data subject" means you, the person who owns and who will provide us with your Personal Information for processing, which reference is found under POPIA;
"Personal Information" means any information that falls within the definition of 'personal information' as defined in POPIA;
"Responsible Party" means a public or private body or any other person which, alone or in combination with others, decides the purpose of and means for processing personal information, as defined in POPIA;
"you" means the data subject, who will be providing us, the Responsible Party with your Personal Information, for processing under POPIA.
1.5 Energenic GL reserves the right to amend this Policy or add provisions to it at any time and an updated version can be accessed on our website.
1.6 By accessing our website located at www.energenic-gl.co.za, you acknowledge this Policy and agree to be bound by the terms hereof. If there is anything you do not understand please email any inquiry to info@energenic.co.za. If at any time you do not agree to this Privacy Policy, please do not use our website.
1.7 This Policy applies to:
1.7.1 Persons who interact with us in person, via email, through our websites, applications, mobile apps, or social media platforms, as well as those who visit our premises, offices, or facilities;
1.7.2 Persons who use our online platforms to learn more about us, make inquiries about our products or services, or engage in business with us—whether by supplying goods or services to us or purchasing from us;
1.7.3 Persons who use or purchase our products or services, receive marketing communications, or engage with us through any means, including in person, via email, or through our digital platforms;
1.7.4 Persons who supply goods or services to us, receive goods or services from us, or interact with us in any capacity, whether in person, via email, or through our digital platforms, including visits to our sites, offices, or facilities.
2. THE PERSONAL INFORMATION COLLECTED
2.1 Energenic GL collects Personal Information of a data subject as follows:
2.1.1 Directly from the data subject and/or in the course of our relationship with a data subject and/or in the course of selling goods to and providing services to a data subject;
2.1.2 During the course of interactions with a data subject;
2.1.3 When a data subject visits our offices, our website and/or electronic and social media platforms;
2.1.4 From third parties, if the collection from third parties is required by law or forms part of a public record.
2.2 Energenic GL collects, for example, the following Personal Information:
2.2.1 Personal details of natural persons (e.g., full name and surname, passport or ID number, contact details, physical addresses, tax information, etc.);
2.2.2 Details of juristic persons (e.g., registered name, registration number, VAT number, contact details, authorized representatives, banking and address information);
2.2.3 Transaction details (e.g., payment amounts, sale dates, delivery or service details);
2.2.4 Contracted service provider details (e.g., company names, contact persons, registration and tax info, B-BBEE details);
2.2.5 Employee details (e.g., demographics, identity information, contact info, criminal records, employment history, emergency contact details);
2.2.6 Other details legally required to verify a data subject’s identity.
2.3 All Personal Information must be true, accurate and current. It is the responsibility of the data subject to notify Energenic GL of any changes.
2.4 If a data subject provides the Personal Information of another person/entity, they must ensure that consent for processing by Energenic GL has been obtained.
3. USE OF PERSONAL INFORMATION
3.1 Energenic GL will process Personal Information as follows:
3.1.1 In the ordinary course of business;
3.1.2 To comply with legal/regulatory obligations;
3.1.3 With data subject’s consent;
3.1.4 Where legally permitted.
3.2 Personal Information is processed for the following purposes:
Providing products/services
Job applications
Supplier applications
B-BBEE assessments
Contract formation
HR functions
Market research
Marketing and sales
Legal rights and claims
Fraud prevention
Website improvement
Internal operations
Compliance
Accounting and recordkeeping
3.2.15 Disclosure of Personal Information:
To employees or service providers for business operations and communication;
As required by law, subpoena, court order, or legal processes;
To our service providers under contract;
To auditors, consultants, legal and professional advisors, and government authorities.
3.3 When we share Personal Information with third parties:
3.3.1 They must comply with this Policy and applicable laws;
3.3.2 They must use it only for services provided to Energenic GL.
3.4 Personal Information may be shared during business restructuring, such as mergers or asset sales.
3.5 Personal Information may be shared with affiliates under similar compliance terms.
6. NON-PERSONALLY IDENTIFIABLE INFORMATION (NPII)
6.1 Our website may collect anonymous usage data not linked to individuals.
6.2 We use Google Analytics and cookies to analyze usage. Google may store this data in the US and share it with third parties. You may disable cookies in your browser, but this may limit functionality.
We also use pixel tags and other tools to analyze behavior, measure marketing effectiveness, and improve the user experience. This may include data like browser type, IP address, OS, and visit timestamps. We do not track other websites' activity.
Some emails may also contain pixel tags to monitor engagement. Third-party providers may use tracking to deliver online ads, but no Personal Information is shared with them.
NPII may be combined with other data to improve services and personalize experiences.
TRANSBORDER TRANSFER OF PERSONAL INFORMATION
6.1 Energenic GL may transfer data internationally for cloud storage.
6.2 When doing so, we ensure the receiving country has similar data protection laws and require compliance with such standards.
7. SECURITY AND DATA RETENTION
7.1 Energenic GL has implemented technical and organizational safeguards in line with POPIA.
7.2 We use physical, electronic, and administrative security measures to protect data, including restricted access, encryption, and passwords.
7.3 While we take steps to secure data, internet transmissions are not fully secure. Use of the site is at your own risk.
7.4 We will notify affected parties and regulators of any data breach.
7.5 We are not liable for any damages resulting from unauthorized access despite safeguards.
7.6 Personal Information is retained only as long as necessary in accordance with the law.
7.7 We review systems and data regularly. Our services are not intended for individuals under 18 or those without legal capacity.
